Traffic accidents can be overwhelming and stressful, but knowing your legal obligations in Arizona can make a big difference in how you handle the situation. Whether you’re driving in Phoenix, Gilbert, or Peoria, following the law is essential to avoid serious legal and financial consequences. Here’s a comprehensive guide to help you navigate the aftermath of a traffic accident and protect your rights.
Stay at the Scene
Leaving the scene of a traffic accident in Arizona is a serious offense. Regardless of the severity of the collision, fleeing the scene can lead to criminal charges, including hit-and-run. It’s crucial to stay at the accident site until the proper authorities arrive or until it’s safe to leave.
- Why This Matters: Fleeing the scene complicates the situation and could escalate a minor accident into a major legal issue. It’s essential to remain where the incident occurred to avoid facing severe legal consequences.
- Tip: If the accident happens on a busy road, move your vehicle to a safe spot nearby, if possible. Turn on your hazard lights to alert other drivers and prevent further accidents.

Provide Your Information
Arizona law mandates that drivers involved in an accident exchange key information with the other parties involved. This helps ensure accountability and facilitates the claims process.
Required Information
- Your Name and Address: Provide accurate, up-to-date contact details.
- Vehicle Registration Number: Make sure your registration is valid and accessible.
- Driver’s License: You are legally required to show your driver’s license if requested by another driver.
Failure to provide this information could lead to fines or further complications, particularly when it comes to insurance claims.

Assist Injured Parties
If anyone is injured in the accident, you have a legal duty to assist.
What This Means
Providing reasonable assistance could include calling 911 for medical help or offering support until emergency responders arrive. Even if the injuries seem minor, offering help can prevent more severe consequences later.
Why This Matters: Neglecting to help an injured person could result in legal liabilities, including potential charges for failing to render aid.
Notify Authorities
In some accident scenarios, contacting law enforcement is required by law or highly recommended.

When to Call the Police
- Serious Injuries or Fatalities: Always call 911 if someone is seriously injured.
- Significant Vehicle Damage: If the crash causes major vehicle damage, it’s essential to involve the police for documentation purposes.
- Disputes or Unclear Fault: If there is any disagreement about the accident or who is at fault, the police report will be crucial for resolving disputes later.
A police report provides an official record that can be instrumental in resolving insurance and legal issues.
What to Do If You Hit a Driverless Vehicle
With autonomous vehicles becoming increasingly common in Arizona, especially in cities like Phoenix and Chandler, accidents involving driverless cars present unique challenges. However, the legal process remains similar to any other traffic accident.
Key Steps
- Stay at the Scene: Even if the vehicle involved is driverless, you must remain at the scene.
- Notify Authorities: Although autonomous vehicles often alert the authorities automatically, it’s crucial to call the police to ensure the incident is handled correctly.
- Provide Your Information: Exchange your name, address, and vehicle registration as you would in any other accident.
Take Additional Steps to Protect Yourself
In addition to following the legal requirements, taking proactive measures can help safeguard your interests and simplify the process of dealing with insurance claims and legal disputes.
Document the Scene
Take clear photos of the damage, license plates, and the overall scene. This evidence can prove invaluable when disputing claims or clarifying what happened.
Gather Witness Information
If there are any witnesses to the accident, ask for their contact details. Eyewitness testimony can be crucial in situations where fault is disputed.
Contact Your Insurance Provider
Inform your insurance company about the accident as soon as possible. Provide them with all the necessary details, including photos, the police report, and any other relevant documentation.
What to Avoid After an Accident
While it’s important to take appropriate action, there are several things you should avoid doing after a traffic accident in Arizona.
Admitting Fault
Never admit fault or apologize at the scene of the accident. Determining fault is a legal process, and it’s best left to the authorities or insurance adjusters.
Ignoring Injuries
Some injuries may not be immediately apparent. If you feel any discomfort, even if it’s minor, seek medical attention. Delayed injuries could lead to complications later.
Delaying Contact with Authorities
If the situation requires police involvement, report the accident promptly. Delaying the police report could complicate your legal position and insurance claims.
What Happens If You Don’t Follow the Law?
Failing to follow Arizona’s accident laws can result in serious consequences. Here are some of the legal and financial repercussions:
Hit-and-Run Charges
Leaving the scene of an accident is a criminal offense that could lead to heavy fines, license suspension, or even jail time. The state treats hit-and-run incidents very seriously, regardless of the accident’s severity.
Increased Liability
Failing to provide your information or assist injured parties can make you liable for additional damages or legal penalties. If you’re found at fault for leaving the scene or neglecting your duties, you could be responsible for higher financial liabilities.
Insurance Complications
Without proper documentation, your insurance claim could be denied. This means you could end up paying for repairs, medical expenses, and other costs out of pocket.
