TYPES OF SEX CRIMES
The law recognizes numerous forms of sexually-based offenses and each of them has serious consequences to be aware of. Some of the allegations a sex crimes attorney in El Mirage could dispute include the following charges, among others.
POSSESSION OF CHILD PORNOGRAPHY
Under Arizona law, the possession of material involving a juvenile is known as sexual exploitation of a child. A Class 2 felony, being convicted of this offense has the potential to send a person to prison for the rest of their life. Different types of behavior can lead to a conviction for this charge. They include selling, downloading, or purchasing photos or videos of minors engaged in any form of sexual activity.
SEXUAL ASSAULT
This offense involves sexual intercourse of any kind without the other person’s consent. Known as “rape” in many jurisdictions, a conviction for this offense can lead to as much as 14 years in prison. Multiple offenses or defendants with aggravating factors present could face even more time behind bars.
SEXUAL CONDUCT WITH A MINOR
Frequently referred to as statutory rape, this offense involves some kind of sexual act with a juvenile. There is nuance to be aware of, as a person over the age of 18 is more likely to face steeper penalties than a defendant that is age 15 to 17. In either case, you need to call Grand Canyon Law Group as soon as you can so we can begin working your case.
REGISTERING AS A SEX OFFENDER
The consequences of a conviction in these cases go well beyond jail time or fines. Even after a person serves their sentence, they can expect additional consequences like mandatory registration as a sex offender.
Different factors impact whether removal from the registry is an option. For example, anyone in a situation where the alleged victim was under the age of 15 does not qualify for removal from the registry. A sex crimes attorney could advise someone in El Mirage when it may be possible to get off this list, if that right is applicable at all.

POTENTIAL DEFENSE STRATEGIES
There is no one one-size-fits-all approach to fighting back against these allegations. In fact, some strategies are appropriate for some offenses but not others. For example, consent is one of the strongest defense strategies in sexual assault cases, but it is never a viable tactic for a defendant charged with sexual conduct with a minor, since the law says minors cannot give legal consent under any circumstances. Some other common approaches include:
- Lack of evidence
- Mistaken identity
- Speedy trial violations
- Law enforcement misconduct
Finding the right way to fight back against the state can be difficult without help. Experienced legal counsel can evaluate all available options and choose an approach based on the facts.
