BRIBERY OF PUBLIC OFFICIALS IS A FELONY

Under Arizona Revised Statutes §13-2602, it is a class 4 felony for any person to offer or confer any benefit to a public servant or official to influence that party’s actions within their governmental role. It is also illegal for any public servant to accept or solicit such an offer. If convicted of this offense, a defendant faces up to 3.75 years in prison. Offering to influence the actions of a public official on another person’s behalf in exchange for personal benefit is also a class 4 felony under A.R.S. §13-2606, even if no undue influence is actually exerted.

Other than lawful contributions to political campaigns, it is a class 6 felony to solicit, offer, or provide a nomination for public office or appointment to a governmental position in exchange for personal favors or benefits, under A.R.S. §13-2603. A conviction for this offense could lead to up to two years imprisonment. Notably, a conviction will also prohibit the defendant from ever holding public office again, as per A.R.S. §13-2604. Our Mesa bribery attorneys can fight charges filed under any of these statutes to protect a defendant’s rights and freedom.

WHAT ARE ARIZONA STATE LAWS FOR COMMERCIAL BRIBERY?

According to A.R.S. §13-2605, commercial bribery is when someone provides some sort of benefit to an employee with the intent of encouraging them to engage in conduct that will cause their employer to suffer economic loss. It is also a criminal act for an employee to accept such a benefit with an understanding of its implications.

The penalties associated with a conviction for commercial bribery vary depending on the value of the benefit offered or received.

  • Acts involving less than $100 are class 1 misdemeanors
  • Acts involving between $100 and $1,000 are class 6 felonies
  • Acts involving over $1,000 are class 5 felonies

The knowledgeable attorneys at Grand Canyon Law Group can help you understand the specific commercial bribery charges against you and fight to reduce your chances of conviction.
