The impact of a criminal record can be far-reaching. Even when you have completed all the requirements of your sentencing, you may find that previous charges continue to hold you back in life. However, you may have legal options for setting aside your conviction.
While getting a court to set aside a conviction can be challenging, assistance is available from the experienced attorneys at the Grand Canyon Law Group. Our Chandler expungement/set aside lawyers are here to help you move forward with your life, and we are ready to fight for your rights.
DIFFERENCE BETWEEN SET ASIDE AND EXPUNGEMENT IN CHANDLER
Unfortunately, Chandler does not allow parties who have served their sentence to receive a pure expungement of the conviction. However, convictions may be “set aside.” This involves the court marking a conviction as “set aside” on a person’s criminal record.
Potential employers often look more favorably at a set aside conviction. Additionally, a set aside conviction can improve one’s chances of acquiring specific professional licenses or obtaining better living conditions. It can be difficult to obtain housing in some areas of Chandler with a criminal conviction, but pursuing a set aside can improve a person’s housing opportunities. A knowledgeable local attorney can advise an individual on pursuing set aside status for their conviction.
CONDITIONS NECESSARY FOR SETTING A CONVICTION ASIDE
Chandler’s requirements for setting aside or expunging a conviction are explicitly stated in Arizona Revised Statutes 13-905. Upon release from probation or incarceration, a person may petition the court to set aside their conviction.
The following considerations will be considered by the court when deciding whether or not to grant the set aside petition:
- The applicant’s compliance with probation
- The applicant’s criminal record before and after conviction
- The nature of the applicant’s convictions and the circumstances surrounding them
- The amount of time passed after the applicant’s sentence was completed
- The age of the applicant at the time of the conviction
There are additional factors that the court may consider, but these are circumstantial and applied on a case-by-case basis. Reviewing a potential claim with a Chandler set aside attorney may reveal factors that persuade a court to grant the petition.
CERTAIN CRIMES ARE NOT ELIGIBLE TO BE SET ASIDE
Arizona state law does not allow all convictions to be set aside, even with help from a qualified Chandler attorney. In general, a set aside/expungement cannot supersede public policy seeking to protect other citizens.
For instance, many crimes that require sex offender registration are not eligible to be set aside/expunged. Crimes involving deadly weapons, known as “dangerous offenses,” or felonies involving minors also can not be set aside. Certain traffic infractions will remain on a person’s record as well. Driving on a suspended license or violations involving local ordinances may also disqualify a person from having their conviction set aside.
