When you are involved in a collision with another motorist, the law generally requires you to remain at the scene. This is certainly the case if either party involved the crash is injured. Despite these requirements, it is not uncommon for a driver to leave the scene following a collision. These are commonly known as “hit and run” accidents. The offense is also known as “leaving the scene.”
There may be many circumstances that led to charges for a hit and run accident. WHAT QUALIFIES AS A HIT AND RUN ACCIDENT?
The term “hit and run” is not used in every situation where a person leaves the scene of a vehicle collision. Likewise, leaving the scene in an ambulance due to injury does not qualify as a hit and run either.
In criminal cases, this term is used to describe when someone involved in a serious accident leaves the scene without speaking to the other driver. Typically, one motorist will stop to exchange information with the other driver, while the other will speed away. Under these circumstances, leaving the scene of an accident is a criminal offense. A conviction could lead to serious consequences, which makes it critical for anyone accused to speak with a Chandler hit and run attorney.
PENALTIES FOR HIT AND RUN OFFENSES IN CHANDLER
The circumstances of the accident will determine the penalties for a hit and run conviction. Under the law, there are two separate criminal offenses that are related to leaving the scene of an accident. The first involves fleeing after a serious collision, and the second is related to the failure to stop after striking a parked vehicle.
FLEEING THE SCENE OF AN ACCIDENT
Fleeing the scene of a crash where another person suffered injury is treated as a felony offense. If the injuries are fatal, the offense increases to a class 5 felony. The severity of the offense increases when a driver involved in a fatal accident flees the scene. In these cases, the offense is treated as a class 3 felony. The offense is upgraded to a class 2 offense if the person responsible for a fatal crash leaves the scene without stopping.
FAILING TO STOP AFTER STRIKING A PARKED VEHICLE
If a driver hits a parked vehicle, causes property damage, and leaves the scene without contacting the owner of the vehicle, they could face class 3 misdemeanor charges. Although the charges related to a hit and run accident are not as serious when it involves the failure to stop after hitting a parked vehicle, it is still important to consult a nearby hit and run lawyer to discuss potential defense strategies.
